Privacy Policy

1. INTRODUCTION

In this Privacy Policy ("policy"), "you" and "your" refer to each customer ("customer") and "we", "us" and "our" refer to Rideau Networks, 6415539 Canada Inc. ("Rideau Networks").

This policy has been created to inform our customers and employees of our compliance with the federal government's Personal Information Protection and Electronic Documents Act (PIPEDA). As of January 1st, 2004, all businesses in Canada are required to comply with PIPEDA to safeguard all personal information they hold in the course of doing business.

2. WHAT IS PERSONAL INFORMATION

Personal information collected by Rideau Networks about its' customers includes the following:

  1. Your name
  2. Your mailing and billing addresses, telephone and fax numbers, e-mail addresses, and any other contact details.
  3. Financial information including credit card numbers, historical payment information, and any data collected during a credit check.
  4. Details about past and current account usage, including all automated log files.

3. USE OF PERSONAL INFORMATION

Rideau Networks will use your personal information for the following purposes:

  1. To establish and maintain an account through which we provide our services to you, and to provide technical support for those services.
  2. To bill and collect fees from you for the services provided.
  3. To meet any legal or regulatory requirements.

Our customers and users will occasionally receive newsletters or e-mails with information on products, services, or special offers. Out of respect for the privacy of our users, Rideau Networks gives them the opportunity to opt-out from receiving these types of communications.

On rare occasions, it is necessary to send out a strictly service-related announcement, if, for instance, our service is temporarily suspended for maintenance. Generally, users may not opt-out of these communications.

Should Rideau Networks need to use your personal information for other purposes than those outlined above, you will be notified in advance. You have the right to refuse permission for us to use of your personal information for new purposes.

4. CONSENT

Rideau Networks will obtain consent before or when it collects, uses or discloses personal information about an individual. An individual can provide consent to the collection, use and disclosure of personal information about them expressly or implicitly. Rideau Networks will collect, use or disclose personal information without an individual's consent only in limited circumstances as permitted by law.

Subject to certain legal and contractual restrictions and reasonable notice, an individual can refuse or withdraw their consent to the collection, use or disclosure of personal information about them at any time.

All existing customers will be informed of what types of personal information have been collected, the purpose for the collection and the procedures available for contacting Rideau Networks with any inquiries. All new customers will be provided with a written explanation (by post, fax or e-mail) about the collection, use and disclosure of their personal information when requesting service.

5. LIMTING COLLECTION OF PERSONAL INFORMATION

Rideau Networks limits the amount and type of personal information it collects to that which is necessary to provide and maintain our services to you. Personal Information will be collected using procedures which are fair, transparent and lawful.

6. LIMITED USE, RETENTION AND DISCLOSURE

Rideau Networks will only use the personal information for the purpose for which it was collected as identified in section 3 of this policy, unless consent is given by the individual to use or disclose it for another purpose.

Rideau Networks will retain your personal information until your account has been closed, or until it is no longer required by any legal or regulatory requirement.

Rideau Networks treats your personal information as confidential and does not disclose it or use it without your consent, except where such Personal Information is require to be disclosed under certain circumstances:

  • Billing, settlement or operation purposes.
  • Law enforcement purposes.
  • Complying with a legal or regulatory requirement.
  • Processing of your past due accounts which have been passed to a debt collection agency.
  • Emergency situations.

Rideau Networks may engage employees, contractors, and other companies or third parties to perform work that involves access to Personal Information. In any case, Rideau Networks will ensure that such parties are required to keep the information confidential and not to use it in any way other than as is necessary to perform their work for us.

Rideau Networks may disclose summary information obtained by combining data from many accounts, provided that the information has been sufficiently aggregated such that any personal identifiers cannot reasonably be identified.

7. ACCURACY

In order to ensure the reliable delivery of our services and the correct billing for our services, all personal information will be kept accurate, complete and up to date.

Individuals may challenge the accuracy and completeness of personal information about them and have it amended, as appropriate.

8. SAFEGUARDS

In executing its responsibilities with respect to the confidentiality of personal information, Rideau Networks will employ a number of safeguards, appropriate to the sensitivity of the information, to protect personal information against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification. Such safeguards will include physical measures, organizational measures and technological measures.

9. INDIVIDUAL ACCESS

Any customer of Rideau Networks can have access to the personal information about them that Rideau Networks has in its possession or control. Any customer may request that their personal information be amended for purposes of accuracy and completeness.

10. CHALLENGING COMPLIANCE

As required by the PIPEDA, you may challenge Rideau Networks' compliance with this Privacy Policy by contacting Rideau Networks directly. If you are not satisfied with the way Rideau Networks has responded to a complaint, you can contact the Privacy Commissioner of Canada.
